Disease

Keoghs has been handling all manner of industrial and occupational disease claims for both insurer and self-insured clients for a number of years. 

In 2007 we established our dedicated disease team which brought together all our existing in-house expertise.  In addition we have recruited new, highly experienced solicitors to extend the breadth and depth of expertise available within the team. 

Having a centre of excellence has really focused the strengths and technical knowledge of our disease lawyers.  The team is working together to challenge the old school perception that all disease claims are unique and need to be handled “traditionally”.  We are successfully applying a fresh perspective based on Keoghs’ tried and tested, process-driven approach, proactivity, streamlining and delegation of authority.   

A number of factors illustrate the success of this new approach - cycle times are reducing, the level of damages and costs is being contained more effectively and we are seeing an increasing number of our disease cases discontinued.

The disease team has a proven track record of successfully defending all types of disease claims – from more routine, low value cases through to high value, complex claims.  These range from asbestos-related illnesses such as mesothelioma and lung cancer to hand arm vibration syndrome, noise-induced hearing loss, work related upper limb disorder, stress-related illnesses, dermatitis and occupational asthma. 

We are used to handling the circumstances and scenarios that are unique to disease claims.  For example, we have substantial experience of co-ordinating our clients’ 'first response' to a particular type of claim to safeguard them against a floodgate scenario. Here, it is essential to develop a strategy at the outset to either fight and win the first case or, alternatively, to minimise the knock-on effect of compromising early claims. We have worked with many clients to formulate their policy for floodgate scenarios involving, for example, WRULD, HAVS and dermatitis.

We have spent many years working closely with corporate clients in this field (a number of which choose to instruct us directly), and we are acutely aware of the sensitive nature of this type of work.
