First Party Fraud

In the current economic climate the threat posed to insurers by first-party fraud (otherwise know as insured fraud or policyholder fraud) has increased substantially.

At Keoghs, we have leading expertise and knowledge in both insurance fraud and insurance contract law, helping insurers to investigate suspicious first-party motor and property claims - saving thousands of pounds in the process.

We deal with all types of fraudulent property and motor claims on behalf of insurers including arson, subsidence and staged theft.

In many first-party fraud cases, fraud itself can be very difficult to prove.  There may be many legitimate reasons for suspicion raised during investigations but the burden of proof in fraud cases is particularly high.

In our experience, pleading fraud is not actually necessary in many cases as there are generally other technical arguments which can be used to counter the claim.  Using their knowledge and experience of such matters, our insurance law experts will investigate all possible technical issues such as policy defences of material non-disclosure or misrepresentation, and breaches of warranty or condition.

In order to maximise the savings available, it is essential to appoint Keoghs early.  We will be able to advise you based on the weight of the evidence you have available at the time, and can direct future investigations to gather any further evidence that will be needed to strengthen your case.
