The Supreme Court has unanimously rejected the insurers' challenge to the Damages (Asbestos related conditions) (Scotland) Act 2009. This reverses the House of Lords decision in Rothwell and declares asymptomatic pleural plaques to be actionable personal injury. Identical legislation exists for Northern Ireland and is now likely to be brought into effect.
