A mesothelioma claim brought by a living claimant resulted in judgment being entered in their favour. In the assessment of damages hearing on 26.01.2012 HHJ Swift  awarded £50,000 and considered the wide variance in the wording in respect of mesothelioma claims in the 7-10th Judicial Studies Board (JSB) Guidelines (2007-2010) with the traditional approach of the courts and analysed factors which should affect the level of damages.
