Biography
David is one of the country's leading occupational disease lawyers. During his career he has acted for a wide range of clients from major composite insurers to the Ministry of Defence, local authorities, large multinational corporations and the NHS. David advised the only parties outside the Government and the Claimants Group to successfully accede to the handling agreement in the coal mining respiratory disease litigation (the biggest personal injury compensation scheme in the world). He has also successfully handled a number of cases in the Court of Appeal and House of Lords; notable cases include Bonser v RJB Mining CA (stress at work), W v Doncaster MBC CA (false imprisonment/Mental Health Act/Human Rights Act), Rothwell & Others CA and HL (pleural plaques test litigation), Crocker v British Coal Corporation, QBD (PTSD/Limitation) and Carter v SIG Plc, QBD Appeal from Summary Judgment, cited in the White Book. David is advising the ABI and leading legacy insurers on the establishment of the mesothelioma untraced scheme and associated package. He also heads the Disease Sector Focus Team in FOIL (the Forum of Insurance Lawyers).
