Large Loss - Catastrophic Injuries
Large loss and catastrophic injury claims are few in number but have a disproportionately large impact on indemnity spend.
We have a specialist Large Loss team, dedicated to providing a proactive, practical and cost effective service in this complex and sensitive area. The team includes some of Keoghs’ most experienced and recognised partners and lawyers.
How we can help
Our approach to this type of claim is to target a resolution time scale at the outset, within the environment of proactive rehabilitation where appropriate. We encourage a consensual approach, drawing the claimant and their advisers towards mediation or a settlement meeting at the earliest opportunity, with a view to minimising the indemnity spend.
In cases where an opponent takes a more aggressive approach to the claim, our tactics are modified to highlight the mitigation issues in order to draw the claimant back to the negotiation table.
A centre of technical excellence, the team exchanges ideas on new developments and advances new methods for both rehabilitation and the speeding up of the claims process.
We also work closely with external experts on matters such as rehabilitation.
Services
We regularly advise on:
- Amputations
- Brain injury
- Multiple injuries
- Regional Pain Syndrome / Fibromyalgia and other chronic pain syndromes
- Serious spinal injury.
Benefits
Depth of expertise and knowledge. Three of our partners sit on the £1million+ panel for our largest insurer client, and we are included on the catastrophic panels for a number of other insurers. A number of the team have heavy involvement with professional associations - for example Andrew Underwood was President of FOIL (Forum of Insurance Lawyers) in 2005 and now chairs FOIL’s newly formed Process and Rules Special Interest Group.
Respected by claimant firms. Our partners have gained a lot of respect from the claimant serious injury community through their emphasis on building a dialogue. This reduces wasted resource committed to minor points and cases are driven to an early resolution.
Excellent relationships with service providers. The team has built up strong working relationships with counsel, medical and other experts allowing for the best advice to be provided to our clients.
Professional recognition. We are ranked by Chambers and Legal 500 for Defendant Personal Injury work. We are described by Legal 500 as having
“an excellent reputation for catastrophic injury and disease cases.”
