Motor Crime and Regulatory

Defending you against prosecution

Our Motor Crime and Regulatory team deals with all aspects of criminal and regulatory prosecution arising from personal injury or death on the road, at work or in a public place.

We represent individuals and companies facing prosecution and can assist those facing:

  • Prosecution by regulatory authorities, such as The Health and Safety Executive (HSE), Trading Standards, Environmental Health Authority, The Environment Agency and Local Authorities.
  • Driving offences, such as Dangerous Driving, Death by Dangerous Driving and Driving Without Due Care and Attention.

Acting quickly

Following a serious accident on the road or in the workplace, the first 72 hours are crucial. Prosecuting authorities act quickly, and so must you. You need to make sure you have someone on your side.

How we can help

We have many years of experience of advising individuals and companies facing criminal or regulatory investigations and possible prosecution.

We are skilled in handling the full range of cases, from minor accidents in the workplace or on the road through to very complex cases involving multiple fatalities.

Our team is based in Bolton and Coventry, and we are able to serve all of England and Wales from these locations.

Speedy advice is essential. We offer a 'red alert' service which means that we will get to an accident scene swiftly so that we can be involved in the immediate aftermath.

Services

  • Immediate post-accident attendance. Early attendance is vital.
  • Representation at interview and beyond. We will represent you from the earliest stages of investigation, through interviews by the prosecuting authority to prosecution before a criminal court, and at a coroner's inquest if a fatality is involved.
  • Obtaining key witness evidence.
  • Obtaining essential expert evidence which can win or lose a case.
  • Keeping you up to date. We will keep you informed every step of the way.
  • Representation at Inquests, Magistrates Courts and Crown Court.

Benefits

Instructing Keoghs as soon as possible after the incident means that:

  • Swift representation is available to you.
  • You will gain an early understanding of potential risks of prosecution.
  • We have access to preliminary prosecution materials and evidence so we can assess the strength of that evidence and make an initial assessment.
  • We can more accurately advise your insurer on liability, quantum and a realistic reserve.
  • Evidence can be marshalled more effectively at the scene of the incident.
  • Unnecessary investigations can be avoided, achieving costs savings.
  • The value of the civil claim may be reduced.
  • A prosecution may be prevented.
  • Professional recognition. We are recommended for Crime and Health and Safety by The Legal 500, describing the team as ‘strong, well-balanced’.
