Commercial Litigation

Disputes are a fact of life, which if poorly handled, can become a massive drain on resources, in terms of both time and money.

Keoghs’ Commercial Litigation team resolves all types of dispute relating to property and non-personal injury matters.   We deal with:

  • Policy interpretation and disputes – indemnity, coverage, avoidance, breach of conditions, warranties
  • Property damage claims - from e.g. subsidence, fire, flooding, water damage, defective design / construction and arson
  • Subrogated recoveries
  • First party fraud – particularly on property, motor and protection policies.
  • Product liability
  • Goods in transit claims
  • Negligence, Nuisance and Breach of Statutory Duty
  • Construction, plant, engineering, contract works and utilities
  • Contract and indemnity issues
  • Professional negligence / indemnity

These claims can be very technical and require a deep understanding of insurance contract law and policy wording - and this is where the team excels.

Clear, shrewd and, above all, realistic advice
Alternative Dispute Resolution techniques (e.g. mediation) are widely used.  Using these methods, disputes can be resolved more quickly and at lower cost, disruption is minimised and relationships can be maintained.  However, if an amicable solution is not possible, we will pursue cases to resolution with drive and vigour.

A variety of “packaged” solutions are available for certain types of claim including recoveries, subsidence and innocent purchasers.
